Rudy's Owner Disputes Cockfighting Charges E-mail

After being linked to an alleged cockfighting ring in Santa Ynez, a part-owner of Rudy’s Mexican restaurants on Friday denied charges of harboring dozens of fighting fowl.

Rudy Alvaro Jr., 37, faces misdemeanor charges of animal cruelty and possessing fighting cocks, according to the Sheriff’s Department.

But Alvaro, who owns one of six restaurants in the award-winning chain from Carpinteria to Buellton – his father owns the rest -- said the birds were bred strictly for show, and that he has awards to prove it.

Suit Settled in Veterans Day Arrest, Police Policy Adjusted E-mail

A man arrested for disturbing the peace on Veterans Day as he read aloud the names of American war dead will receive $17,000 from the city of Santa Barbara, which has agreed to revise policing policies under terms of a settlement.

Announced Friday by the ACLU of Southern California representing Michael Tocher, formerly of Nipomo, the agreement also calls for the Police Department to expand training procedures.

“We think this settlement will benefit the whole community," ACLU attorney Peter Bibring said. "“A person who is trying to communicate a message is not disturbing the peace."

State Supreme Court Hears Janeway Drowning Case E-mail

The city of Santa Barbara should be held responsible in the 2002 death of Katie Janeway -- a young teenager who drowned at Los Banos Pool when she was on a field trip there with a summer camp for developmentally disabled children -- a lawyer for her family told the California Supreme Court Tuesday.

However, the city's attorney remained adamant that no camp employee willfully injured the 14-year-old girl and that Santa Barbara bears no responsibility in her death.
 
The oral arguments are a critical milestone in the case, which has languished in the legal system for nearly five years. The justices now have 90 days to decide whether the $200 million wrongful death case should proceed to trial or be dismissed. The central issue before the state's highest court is whether a government agency can use a release form as a shield against gross negligence, legally considered the failure to provide even slight care.
